PRESS RELEASE #13
Van Luven Acquires Attorney In Battle To Protect VA Disability Compensation
By Staff Writer: Rick Townsend
7/6/04
After months of trying to find an attorney to take his case, combat disabled Vietnam veteran Dale Van Luven has retained one of the most experienced lawyers in Tennessee.
Attorney at law, Charles Galbreath, 73, of Nashville, Tennessee has agreed to represent and join Van Luven’s fight to protect his VA disability compensation.
Van Luven was facing arrest at any time for non-payment of alimony, which was based on his VA disability compensation. “Mr. Galbreath is going to file the necessary Motions to keep me out of jail until this matter is settled,” Van Luven said.
In addition to being a veteran himself, Galbreath was a Tennessee legislator in the 1950s, a Nashville metro public defender in the 1960s, a state appeals court judge in the 1970s. He is no stranger to the legal system. “I am extremely grateful to Mr. Galbreath for taking my case,” Van Luven said. “I couldn’t have found a better attorney to represent my best interest in this matter,” Van Luven added.
Jere Beery, is another combat disabled Vietnam veteran who had possible arrest hanging over his head as well. Beery was ordered to use his VA disability compensation to pay his able-bodied non-veteran ex-wife $24,000.00 in alimony earlier this year. Vietnam veteran Jack Nebl, of Eatonton Georgia is Beery’s attorney. “My client has given his consent for me to share any and all information concerning his case with Mr. Galbreath,” Nebl stated. Beery and Van Luven both feel what they accomplish in their individual cases can help other veterans nationwide protect their VA disability compensation from similar attacks.
Georgia Superior Court Judge Alan Keeble has ordered a Continuance in the Beery case, and a date for Beery’s Motion for a new hearing has not been set as yet.
Beery has established a web sight for all updates on this developing story. “We had to set up a website. I was being overwhelmed by email asking for information on our cases. Now, I just instruct them to go to WWW.JEREBEERY.COM for any information they may want concerning this issue. Not only will they find our most recent press releases there, but Federal Statute and case histories as well. We are doing everything we can to inform the public about what judges are doing to our disabled veteran’s benefits in state courts, Beery said.
Beery has also been a guest on several national and worldwide radio programs discussing his and Van Luven’s legal dilemma. “I was on the Proactive News with Bill Brumbaugh last week for an entire hour, and then did the Veteran’s Hour with Rick Townsend the next week, Beery said.” Beery is also scheduled to guest host the Veteran’s Hour on July 10th and 31st for the vacationing Townsend. The program can be accessed every Saturday on the internet at www.GCNlive.com at 5 pm, EST. “We will be talking about this issue,” Beery added.
Both Beery and Van Luven have received inquires from as far away as Australia, and are being contacted by other veterans concerning the protection of VA disability compensation almost daily. “We haven’t heard the end of this story yet,” Van Luven concluded. Both men pledge to take legal actions that will benefit other disabled veterans in the future.
